3. Third-Party Booking Platform

Appointments are booked through Vagaro, a third-party scheduling platform, accessible via the "Book Now" links on this Site. When you click through to Vagaro:

• You leave Ella's website and enter a platform we do not own or operate
• Your use of Vagaro is governed entirely by Vagaro's own Terms of Service and Privacy Policy, not by this document
• Ella's is not responsible for the availability, functionality, security, or data practices of the Vagaro platform

6. No Medical Advice

Services described on this Site — including PEMF (Pulsed Electromagnetic Field) sessions, infrared sauna, massage, and related wellness offerings — are provided for general relaxation and wellness purposes only. They are not medical treatment and are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Always consult a licensed physician regarding any health condition before beginning a new wellness therapy, especially if you are pregnant, have a pacemaker or other implanted medical device, or have a chronic illness.

7. Age & Eligibility

Certain services offered by Ella's may have age requirements or health contraindications. Please review service descriptions or contact us for guidance before booking.

8. Appointments, Cancellations & Gift Cards

• Appointments cancelled with less than 24 hours' notice are subject to a 50% cancellation fee. No-call/no-show appointments will be charged 100% of the service price.
• Appointment scheduling, deposits, and rescheduling are managed through Vagaro; please refer to the policy shown at the time of booking or call us directly at (704) 866-9943.
• Gift cards are subject to the terms stated at the time of purchase. Gift cards do not carry an expiration date and are not subject to dormancy or service fees, in accordance with North Carolina law (N.C. Gen. Stat. §§ 66-67.5 and 116B-53–54).

9. Service & Price Changes

Ella's reserves the right to modify, discontinue, or update services and pricing at any time without prior notice. Prices listed on this Site are subject to change.

10. Intellectual Property

All text, images, logos, and design elements on this Site are the property of Ella's Therapeutic Baths & Spa or its licensors, unless otherwise noted, and may not be used without written permission.

11. Disclaimer of Warranties

This Site is provided "as is" without warranties of any kind, express or implied. We do not guarantee the Site will be uninterrupted, error-free, or completely secure.

Any dispute arising from your use of this Site or our services shall first be attempted to be resolved through informal negotiation. If unresolved within 30 days, the dispute shall be submitted to binding arbitration in Gaston County, North Carolina, under the rules of the American Arbitration Association. Each party bears its own costs.

Any arbitration or legal proceeding shall be brought on an individual basis, not as a class action or representative proceeding.

15. Statute of Limitations

Any claim or cause of action arising from these Terms or your use of this Site must be filed within one (1) year after the claim arose.

16. Force Majeure

Ella's shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to natural disasters, pandemics, power outages, or internet service disruptions.

17. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

18. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ella's regarding your use of this Site. This Site's data practices are described in our Privacy Policy.

20. Changes to These Terms

We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
